Perhaps the most commonly sought-after advice by employers is how to discipline or dismiss an employee. A solid disciplinary procedure is an essential tool to enable an employer to run their business efficiently and, provided the correct procedure is followed, this offers the employer some protection against challenge by employees.
Becoming increasingly common is also the workplace grievance. Employees must have the ability to air any genuine workplace concerns and employers must have the correct procedures in place to effectively deal with this.
The ACAS Code of Practice has been given statutory recognition in the sense that unreasonable deviation from its contents will be taken into consideration by the Tribunal. Its contents set out the basic requirements of fairness that will be applicable in most cases, and is intended to provide the standard of reasonable behaviour in most instances.
